In a landmark decision, Nintendo has successfully secured $4.5 million in damages from former Reddit moderator James Williams, better known online as Archbox. The ruling follows a lawsuit filed in 2024, which accused Williams of disseminating pirated Nintendo Switch games and facilitating the means to play them illegally. This victory underscores Nintendo’s relentless pursuit against piracy to protect its intellectual property and sustain the integrity of the gaming industry.
The US District Court for the Western District of Washington granted Nintendo a default judgment after Williams failed to respond to the legal proceedings. The court, led by District Judge Lauren King, confirmed that Williams was well aware of the lawsuit, given his previous engagement of legal counsel to challenge a subpoena. His refusal to further engage with the case did not play in his favor.
Williams’ involvement in the creation and management of multiple Pirate Shops, offering access to extensive libraries of pirated Nintendo Switch games, was at the heart of Nintendo’s lawsuit. Operating since 2019, these Pirate Shops became a hub for gaming piracy, targeting hundreds of thousands of users. Notably, Williams was a leading moderator of the SwitchPirates Reddit group, which amassed 190,000 members, further solidifying his central role in these networks.
Nintendo highlighted the systematic nature of Williams’ operations, detailing how he solicited donations in the form of Nintendo eShop gift cards. These were reportedly used to purchase more games to pirate, filling gaps left by existing pirate circuits. The complaint references 30 specific games, with Nintendo seeking $150,000 in damages per game, pointing to the Copyright Act’s provision for statutory damages for willful infringement.
The court agreed with Nintendo’s assertion that the lost sales due to Williams’ activities could easily reach significant sums, thereby justifying the damages sought. As part of the ruling, Williams is also subject to a permanent injunction, preventing him from distributing pirated Nintendo games or software circumventing copy protection. He is further prohibited from encouraging such actions among others.
